ACERA retirees may return to work for an ACERA employer in one of
two capacities:
-
Reinstatement to Active Member Status: The
retiree’s monthly retirement allowance is paused and they earn
additional service credit while working. When they retire from
the second period of employment they receive an allowance
comprised of their prior allowance (plus cost of living
adjustments) and an additional allowance based on their new
period of service. The employer should inform ACERA at the
earliest opportunity when hiring a retiree who will reinstate
to active member status. Please review
Section 31680.7 for the applicable rules.
-
Working as a Retired Annuitant: The retiree
works in a limited, temporary capacity while continuing to
receive their monthly retirement allowance. Please review
Section 7522.56 for the applicable rules. The employer must
provide written notice to the employee before the employee is
within 80 hours of the 960-hour-per-fiscal-year limit.
Employing a retired annuitant in violation of the rules has
consequences for the employee and the employer per
Section 31680.9.

Retirement for more details.
